General Terms of Use

The purpose of these general conditions of use (known as “CGU”) is to provide a legal framework for the terms of provision of the site and services and to define the conditions of access and use of MyTower services.

These T&Cs are accessible on the site under the “T&Cs” section.

PREAMBLE

Company MyTower, SAS with capital of €2,134,330 whose head office is located at 16 rue de Médéric in 75017 Paris, registered with the Paris RCS under number B 843 849 134, represented by Jean-Christophe CUVELIER.

The MyTower Company (hereinafter “the Organization”) is the publisher of sites, online content and services and mobile or tablet digital media, accessible on all digital terminals and available when Visitors connect.

Article 1 - Definitions

Each of the terms mentioned below will have, in these general conditions of use (hereinafter “the T&Cs”), the following meaning:

Sites and Digital Media: websites, mobile sites, digital media intended for Visitors (hereinafter “Sites and Digital Media”).

Personal Data: any information relating to a natural person identified or who can be identified, directly or indirectly, by reference to a name, an identification number or to one or more elements specific to him or her.

Services: set of functionalities made available to Visitors by the Organization and available on the site and digital media.

Visitor: any natural or legal person accessing the site and digital media for simple consultation purposes and without using a personal account linking them to the Organization.

Article 2 – Acceptance of the T&Cs

Any registration or use of the site implies acceptance without any reservation or restriction of these T&Cs by the Visitor. When browsing the site or requesting contact via the contact form, each Visitor expressly accepts these T&Cs by checking the box preceding the following text: “I acknowledge having read and understood the T&Cs and I accept them”.

In the event of non-acceptance of the T&Cs stipulated in this contract, the Visitor must renounce access to the services offered by the site.

The organization reserves the right to modify the content of these General Terms and Conditions unilaterally and at any time. Any modification will be brought to the attention of Visitors via the organization's website.

Article 4: Access to the site and services

Access to the site and services is possible twenty-four (24) hours a day, seven (7) days a week (7) except in the event of force majeure or an event beyond the control of the Organization and subject to possible breakdowns and maintenance interventions necessary for the proper functioning of the site and services which may be carried out without having informed the Visitor in advance.

The Visitor sends the Organization a request for information via the contact form or any other means (email, telephone, etc.). The Organization sends an email in response to each Visitor.

The Visitor has the possibility of contacting the Organization at any time via the contact form available on the site.

Article 5: Data collection

MyTower undertakes to process all personal data under this contract in accordance with the European Data Protection Regulation (GDPR) which entered into force on May 25, 2018.

The data are confidential within the meaning of Regulation (EC) No. 45/2001 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data by Community institutions and bodies and freely circulation of this data. MyTower will limit access to data to personnel strictly necessary for the execution, management and monitoring of the contract.

In accordance with the Data Protection Act of January 6, 1978 and the Regulations on the Protection of Personal Data, the Visitor has a right of access, opposition, deletion, portability, limitation and rectification to information that concerns him.

Article 6: Intellectual property

The brands, logos, signs as well as all the contents of the site (texts, images, sound, etc.) are subject to protection by the Intellectual Property Code and more particularly by copyright.

The brand “ ” is a trademark registered by the Organization. Any representation and/or reproduction and/or partial or total exploitation of this brand, of any nature whatsoever, is totally prohibited.

The Visitor must request prior authorization from the site for any reproduction, publication, copy of the various contents. It undertakes to use the contents of the site in a strictly private context, any use for commercial and advertising purposes is strictly prohibited.

Any total or partial representation of this site by any means whatsoever, without the express authorization of the operator of the website would constitute an infringement punishable by article L 335-2 et seq. of the Intellectual Property Code.

Please note, in accordance with article L122-5 of the Intellectual Property Code, that the Visitor who reproduces, copies or publishes protected content must cite the author and his source.

Article 7: Obligations of Visitors

As part of the use of the site, Visitors undertake to:

• Comply with the stipulations described in the T&Cs and the laws in force, and respect the rights of third parties;

• Only communicate information, files and other content that conforms to reality, is honest and fair;

• Do not publish advertisements intended to promote products or services;

• Do not disclose personal information (texts, photos and videos) of third parties via the Organization's website without their consent;

• Do not import and disseminate illicit comments or content via the Organization's website, and in particular any infringing, defamatory, insulting, insulting, obscene, offensive, discriminatory, violent, xenophobic or inciting racial hatred content; or any other content contrary to good morals and the rules of decorum;

• Do not integrate and distribute via the Organization's website content that would be contrary to the purpose of our Service;

• Do not communicate or send, through the Organization's website, any content that includes links pointing to illicit or offensive websites or incompatible with the purpose of the Organization's service. ;

• Use the Organization's website to massively send unsolicited messages (advertising or other).

In addition, the Visitor expressly guarantees the veracity and reality of the information transmitted via our contact form.

In the event of failure to comply with one or more of these obligations, we reserve the right to exclude the offending Visitor from the Organization's service.

Article 8: Liability

The sources of information published on the Organization's website are deemed reliable but the site does not guarantee that it is free from defects, errors or omissions.

The information communicated is presented for informational and general purposes without contractual value. Despite regular updates, the Organization's website cannot be held responsible for modifications to administrative and legal provisions occurring after publication. Likewise, the site cannot be held responsible for the use and interpretation of the information it contains.

The Organization's site cannot be held responsible for possible viruses which could infect the Internet user's computer or any computer equipment, following use, access, or downloading from this site.

The Organization's site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.

Article 9: Hypertext links

Hypertext links may be present on the site. Visitors are informed that by clicking on these links, they will leave the Organization's website. The latter has no control over the web pages on which these links lead and cannot, under any circumstances, be responsible for their content.

The decision to activate these links is the full and complete responsibility of the Visitor. The Organization exercises no control over these sites and declines all responsibility for their access, content or use, as well as for any damage that may result from consulting the information on these sites.

Article 10: Applicable law and competent jurisdiction

The contract is subject to French law.

In the event of a dispute over the interpretation or execution of this contract, the parties agree to a preliminary amicable phase.

The Visitor is informed that he can in any case resort to mediation with existing sectoral mediation bodies, or to any alternative method of dispute resolution in the event of a dispute.

In the absence of an amicable solution, the parties agree to submit the said dispute to the Courts of Paris, competent for this contract.
